Sale or Purchase of Property

With time typically “of the essence” in Queensland standard format contracts (meaning certain actions must be taken by the due dates), it is essential that the required actions be taken and advised to the other side by the due dates to prevent the other party to the transaction accruing rights adverse to your interests, eg rights of termination of contract. Our initial advice letter includes notification of all critical dates and the actions that must be taken by those dates.

Property Development

Leasing

Haney Lawyers recommends that a prospective tenant have their lease reviewed by one of our experienced property solicitors to ensure that the lease provides all the rights the tenant requires and to ensure the prospective tenant fully understands their obligations under the lease. We are experienced in negotiating lease terms for your benefit and resolving ambiguous clauses which if left unaddressed can result in costly disagreement during the lease term between tenant and landlord. Importantly, the prospective tenant should ensure that the lease contains an initial term and sufficient options for further terms to provide an acceptable tenure of business premises. Should a business owner decide to sell their business, the residual term will become all important as a positive or negative selling point.
Should a prospective buyer of a leasehold business be presented with limited tenure remaining on the lease (including options), we would recommend that the contract be subject to negotiating further lease terms or a new lease on terms acceptable to the buyer.
